You are expected to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.<\/p><p>We expect you to have a basic knowledge of how the Internet functions, the types of uses that are generally acceptable and the types of uses which are to be avoided.<\/p><p>Common sense is the best guide as to what is considered acceptable use. Definitions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4b765bd elementor-widget elementor-widget-text-editor\" data-id=\"4b765bd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"vpsn-clause\"><span class=\"vpsn-num\">1.1<\/span><div class=\"vpsn-body\"><p>\u201cProvider\u201d or \u201cVPSNERDS\u201d refers to Group44 Pty Ltd ABN 24 703 434 664 and ACN 703 434 664 trading as VPSNERDS.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">1.1<\/span><div class=\"vpsn-body\"><p>\u201cService\u201d or \u201cServices\u201d refers to the products or services ordered from VPSNERDS.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">1.2<\/span><div class=\"vpsn-body\"><p>\u201cCustomer\u201d refers to the person or organisation purchasing or receiving a product or service from VPSNERDS.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">1.4<\/span><div class=\"vpsn-body\"><p>\u201cCustomer Service\u201d means the relationship between VPSNERDS staff and the Customer, with the purpose of assisting the Customer with a question they have asked.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">1.5<\/span><div class=\"vpsn-body\"><p>\u201cMy Account\u201d refers to the billing account supplied to the Customer upon registration, accessible at https:\/\/myaccount.vpsnerds.com .<\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-c621a04 vpsn-legal-section e-con-full e-flex e-con e-child\" data-id=\"c621a04\" data-element_type=\"container\" data-e-type=\"container\" id=\"aup-2-acceptance\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2e4f3bc elementor-widget elementor-widget-heading\" data-id=\"2e4f3bc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">2. Acceptance<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1e4b818 elementor-widget elementor-widget-text-editor\" data-id=\"1e4b818\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"vpsn-clause\"><span class=\"vpsn-num\">2.1<\/span><div class=\"vpsn-body\"><p>The Customer signified acceptance of our Acceptable Use Policy, as well as our Terms of Service, and Privacy Policy, when they submitted their order to VPSNERDS for Services, and that order was accepted.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">2.2<\/span><div class=\"vpsn-body\"><p>The Customer acknowledges that they are solely responsible for ensuring that all Service(s) are in full compliance with this policy, and that they are solely responsible for the files and applications that have been uploaded and executed.<\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-5dafe4a vpsn-legal-section e-con-full e-flex e-con e-child\" data-id=\"5dafe4a\" data-element_type=\"container\" data-e-type=\"container\" id=\"aup-3-unacceptable-content-and-material\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4b70fc1 elementor-widget elementor-widget-heading\" data-id=\"4b70fc1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">3. Unacceptable Content and Material<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ba94ea5 elementor-widget elementor-widget-text-editor\" data-id=\"ba94ea5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"vpsn-clause\"><span class=\"vpsn-num\">3.1<\/span><div class=\"vpsn-body\"><p>The Customer may not publish, transmit, distribute or store any content or material on VPSNERDS servers or network that VPSNERDS believes to be:<\/p><ul><li>pornography or child pornography<\/li><li>excessively violent or incites, threatens or implies violence<\/li><li>information that is defamatory or violates a person\u2019s privacy<\/li><li>related to illegal gambling or firearms trafficking or promotes illegal drugs or violates import or export laws<\/li><li>comprising of harassing content or hate speech<\/li><li>unfair or deceptive under any relevant Fair Trading or Consumer Affairs act in your state<\/li><li>otherwise illegal, malicious, fraudulent, or may result in retaliation against VPSNERDS by offended viewers.<\/li><\/ul><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-6a0d4aa vpsn-legal-section e-con-full e-flex e-con e-child\" data-id=\"6a0d4aa\" data-element_type=\"container\" data-e-type=\"container\" id=\"aup-4-prohibited-use\">\n\t\t\t\t<div class=\"elementor-element elementor-element-b0bfb70 elementor-widget elementor-widget-heading\" data-id=\"b0bfb70\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">4. Prohibited Use<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a04c9bf elementor-widget elementor-widget-text-editor\" data-id=\"a04c9bf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"vpsn-clause\"><span class=\"vpsn-num\">4.1<\/span><div class=\"vpsn-body\"><p>The following Services<\/p><ul><li>Linux cPanel Shared hosting<\/li><li>Linux cPanel Reseller hosting<\/li><\/ul><p>May not for used for storage of backup archives nor any data which is not directly related to and accessible through the website itself.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">4.2<\/span><div class=\"vpsn-body\"><p>Services, including but not limited to cpanel web hosting, windows web hosting, dedicated servers, virtual servers and colocation may not be used for:<\/p><ul><li>IRC scripts or bots<\/li><li>Pirated software or \u201cwarez\u201d sites<\/li><li>IRCD (irc servers)<\/li><li>Image Hosting Scripts (similar to Photobucket or Tinypic)<\/li><li>Bruteforce Programs\/Scripts\/Applications<\/li><li>Mail Bombers\/Spam Scripts<\/li><li>Sites promoting illegal activities<\/li><li>Hacker focussed sites, archives or programs<\/li><li>Lotteries, banking or investment sites (such as Pyramid or Ponzi schemes)<\/li><li>Banner-Ad services (commercial banner ad rotation)<\/li><\/ul><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-06edfa1 vpsn-legal-section e-con-full e-flex e-con e-child\" data-id=\"06edfa1\" data-element_type=\"container\" data-e-type=\"container\" id=\"aup-5-spam-and-bulk-email\">\n\t\t\t\t<div class=\"elementor-element elementor-element-ce66fd2 elementor-widget elementor-widget-heading\" data-id=\"ce66fd2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">5. Spam and Bulk Email<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-79c554d elementor-widget elementor-widget-text-editor\" data-id=\"79c554d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"vpsn-clause\"><span class=\"vpsn-num\">5.1<\/span><div class=\"vpsn-body\"><p>VPSNERDS expressly forbids the use of its servers and network infrastructure for the purposes of SPAM mailings or any other mass mailing which could reasonably be defined as unwanted and\/or unwarranted.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">5.2<\/span><div class=\"vpsn-body\"><p>VPSNERDS allows the use of its servers and network infrastructure for mass mailings based on a mailing list \u2013 whether compiled or purchased \u2013 in accordance with Australia\u2019s Spam Act 2003 and associated amendments.<\/p><p>In summary: you must have received consent from all persons and\/or entities on that list to receive e-mail messages from you or you must have a reasonable previous association with such persons in order to send them e-mail messages as part of a bulk mailing.<\/p><p>For more information on Australia\u2019s Spam Act 2003, please see:<\/p><p>http:\/\/www.dbcde.gov.au\/online_safety_and_security\/spam\/anti-spam_legislation<\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-0078884 vpsn-legal-section e-con-full e-flex e-con e-child\" data-id=\"0078884\" data-element_type=\"container\" data-e-type=\"container\" id=\"aup-6-backup\">\n\t\t\t\t<div class=\"elementor-element elementor-element-f63d2c3 elementor-widget elementor-widget-heading\" data-id=\"f63d2c3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">6. Backup<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d656297 elementor-widget elementor-widget-text-editor\" data-id=\"d656297\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"vpsn-clause\"><span class=\"vpsn-num\">6.1<\/span><div class=\"vpsn-body\"><p>VPSNERDS maintains daily backup images of files and databases to be restored in the event of a system failure, for the following services:<\/p><ul><li>cPanel shared web hosting<\/li><li>cPanel reseller web hosting<\/li><li>Managed VPS Hosting &#8211; If Backup is included as part of the management service<\/li><li>Managed Dedicated Server &#8211; If Backup is included as part of the management service<\/li><\/ul><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">6.2<\/span><div class=\"vpsn-body\"><p>The Customer warrants they will maintain a local or off-site backup of their Service data at all times.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">6.3<\/span><div class=\"vpsn-body\"><p>As per the Terms of Service, VPSNERDS will not be held liable for data loss under any circumstances and it is the Customer&#8217;s sole responsibility to ensure that they have a backup of all data.<\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-1dd8031 vpsn-legal-section e-con-full e-flex e-con e-child\" data-id=\"1dd8031\" data-element_type=\"container\" data-e-type=\"container\" id=\"aup-6-excessive-resource-usage\">\n\t\t\t\t<div class=\"elementor-element elementor-element-6cb761f elementor-widget elementor-widget-heading\" data-id=\"6cb761f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">6. Excessive Resource Usage<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8c0dd3c elementor-widget elementor-widget-text-editor\" data-id=\"8c0dd3c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"vpsn-clause\"><span class=\"vpsn-num\">6.1<\/span><div class=\"vpsn-body\"><p>Per CPU core limits apply to all shared cPanel hosting services and are limited to the following via CloudLinux:<\/p><ul><li>cPanel Shared Hosting Services are limited to 100% CPU, 2GB RAM, and 50 entry processes<\/li><\/ul><p>All limits are enforced utilizing CloudLinux software that monitors resources on all shared cPanel hosting services.<\/p><p>A \u201c503 Service Temporarily Unavailable\u201d page will be displayed to visitors whom attempt to visit the page whilst the limits are being exceeded.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">6.2<\/span><div class=\"vpsn-body\"><p>All shared cPanel and Windows services, the customer may not:<\/p><ul><li>Execute scripts in which the task takes longer than 240 seconds to complete;<\/li><li>Consume greater than 250,000 inodes (1 file equals 1 inode);<\/li><li>Perform any task which generates high IO load or large amounts of system memory;<\/li><li>Perform any tasks which unreasonably consumes excessive server resources causing issues for other Customers on the shared service;<\/li><li>Host or utilise any bit torrent applications, trackers or clients on the shared service;<\/li><li>Execute cron entries with intervals less than 15 minutes;<\/li><li>Operate or utilise a script which does not close MySQL\/MS SQL connections upon completion<\/li><\/ul><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ada80a6 vpsn-legal-section e-con-full e-flex e-con e-child\" data-id=\"ada80a6\" data-element_type=\"container\" data-e-type=\"container\" id=\"aup-7-systems-and-network-security\">\n\t\t\t\t<div class=\"elementor-element elementor-element-666adf8 elementor-widget elementor-widget-heading\" data-id=\"666adf8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">7. Systems and Network Security<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d2e310a elementor-widget elementor-widget-text-editor\" data-id=\"d2e310a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"vpsn-clause\"><span class=\"vpsn-num\">7.1<\/span><div class=\"vpsn-body\"><p>The Customer agrees that they will not, and will not allow any other person to, violate or attempt to violate any aspect of the security of the systems of VPSNERDS.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">7.2<\/span><div class=\"vpsn-body\"><p>The Customer understands that any such violation is unlawful in many jurisdictions and that any contravention of law may result in criminal prosecution.<\/p><p>Examples of violations are:<\/p><ol><li>Accessing data unlawfully or without consent;<\/li><li>Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures;<\/li><li>Attempting to interfere with service to any user, VPSNERDS services or network, including, without limitation, via means of overloading,<\/li><li>&#8220;Flooding&#8221;, \u201cMail Bombing&#8221;, &#8220;Crashing&#8221; or \u201cDenial of Service\u201d;<\/li><li>Forging any TCP\/IP packet header or any part of the header information in any unsolicited manner.<\/li><li>Taking any action in order to obtain services to which the Customer is not entitled.<\/li><\/ol><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">7.3<\/span><div class=\"vpsn-body\"><p>VPSNERDS will take every reasonable measure to mitigate denial of service attacks, however accepts no responsibility for such.<\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-15ed034 vpsn-legal-section e-con-full e-flex e-con e-child\" data-id=\"15ed034\" data-element_type=\"container\" data-e-type=\"container\" id=\"aup-8-non-compliance-and-remedy\">\n\t\t\t\t<div class=\"elementor-element elementor-element-30b6a95 elementor-widget elementor-widget-heading\" data-id=\"30b6a95\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">8. Non-compliance and Remedy<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d0d9e93 elementor-widget elementor-widget-text-editor\" data-id=\"d0d9e93\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"vpsn-clause\"><span class=\"vpsn-num\">8.1<\/span><div class=\"vpsn-body\"><p>Any Service(s) that are found to be in breach of this policy but have not caused any known inconvenience to other Customers will result in an email notification being sent to the Customer asking for changes to be made in order to comply with this policy. The Customer is required to acknowledge this email and advise VPSNERDS what actions have been taken to remedy the breach. Failure to comply may result in the Service(s) being suspended without additional warning.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">8.2<\/span><div class=\"vpsn-body\"><p>Any Service(s) that are found to be in breach of this policy that have caused issues and\/or degradation of service for other Customers will result in immediate suspension followed by an email notification requesting changes be made in order to comply with this policy. The Service(s) will only be unsuspended once the Customer has acknowledged the breach and agreed to remedy the breach.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">8.3<\/span><div class=\"vpsn-body\"><p>Any Service(s) that are found to be in breach of this policy and have recorded a prior breach within three (3) months of the new breach will result in immediate suspension followed by an email notification requesting changes be made in order to comply with this policy. The Service(s) will only be unsuspended once the Customer has acknowledged the breach and agreed to remedy the breach, and a re-activation fee has been paid in full.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">8.4<\/span><div class=\"vpsn-body\"><p>Any Service(s) that are found to be in breach of this policy and have recorded two (2) prior breaches within three (3) months of the new breach will result in immediate suspension followed by an email notification advising that the Service(s) must be moved to another provider immediately. VPSNERDS will supply the Customer with a backup archive of their files if available, and termination of the service and all backup data will occur within seven (7) days. If the Customer does not respond to this notice, the Service(s) may be terminated without further notification.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">8.5<\/span><div class=\"vpsn-body\"><p>Suspension notification emails (as detailed in 8.1 to 8.4) will be sent to the nominated account holder email address, and the Customer warrants that, in line with the Terms of Service, this address will be kept current and up to date. We recommend using an externally hosted email address to ensure continued delivery of important service information and notifications.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">8.6<\/span><div class=\"vpsn-body\"><p>The Customer will be solely liable for any fees or charges that are paid by VPSNERDS to third party providers for the unblocking of any restrictions they have placed due to Service(s) operated by the Customer breaching this policy.<\/p><\/div><\/div><div class=\"vpsn-clause\"><span class=\"vpsn-num\">8.7<\/span><div class=\"vpsn-body\"><p>As per the Terms of Service, the Customer will not be entitled to a refund or credit if any of VPSNERDS Terms, Policies and Agreements have been breached.<\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-43935a7 vpsn-legal-section e-con-full e-flex e-con e-child\" data-id=\"43935a7\" data-element_type=\"container\" data-e-type=\"container\" id=\"aup-9-changes-alterations-to-policy\">\n\t\t\t\t<div class=\"elementor-element elementor-element-a2360cf elementor-widget elementor-widget-heading\" data-id=\"a2360cf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">9.
